Terms of Service

These Terms govern your use of BookTheTour, a tour-planning and booking workspace operated by Anton Kasatkin, trading as BookTheTour, in Portugal ("BookTheTour", "we", "us"). Contact: bookthetour@proton.me.

1. Eligibility and accounts

You must be at least 18 years old and legally able to enter a contract. You must provide accurate information, protect your credentials, and use the account only for an artist or organisation you are authorised to represent. You are responsible for activity carried out through your account.

2. The service

BookTheTour helps you plan routes, research venues, organise booking candidates, and manage professional messages. Routes, travel times, capacities, contact details, opening status, and availability are planning information. You must verify material details and agree commercial terms directly with each venue before relying on them.

3. Professional outreach

You are responsible for every message you send. Messages must be relevant, accurate, lawful, and directed to an appropriate professional contact. You must respect opt-out requests and must not use BookTheTour for spam, harassment, deceptive content, unlawful promotion, or bulk messaging. We may limit or suspend sending to protect recipients and the service.

4. Trial, prices, and renewal

The seven-day Trial is free, does not require a payment card, and does not convert automatically to a paid plan. Pro costs €9.99 per month or €99 per year. Each Pro subscription renews automatically for the same billing period until cancelled. Lifetime Pro costs €199 once, does not renew, and provides Pro access for as long as BookTheTour operates. "Lifetime" refers to the service's operating life, not the purchaser's lifetime or a guaranteed number of years.

These are final EUR prices inclusive of any applicable VAT. No additional VAT or mandatory payment fee is added to the advertised price. The applicable tax treatment and total payable will be shown before payment. Paid checkout is not available until payment and tax configuration is complete.

5. Cancellation

You may cancel a monthly or yearly Pro subscription at any time from the billing controls in your account or by contacting support. Cancellation stops future renewals and takes effect at the end of the current paid billing period, unless applicable law requires an earlier end. You retain paid access until then. Lifetime Pro has no renewal to cancel; you may stop using it or request account deletion. Deleting an account ends access, cancels any active subscription and permanently removes the workspace data described in the Privacy Policy. Deletion does not itself create a refund right, but it does not limit mandatory legal rights.

6. Withdrawal and refunds

The free Trial has no payment to refund. For monthly Pro, yearly Pro and Lifetime Pro, consumers in the European Economic Area generally have a 14-day right to withdraw from a distance contract, starting when the paid contract is concluded. If you expressly request immediate access during that period, the law may permit a proportionate charge for service supplied before withdrawal. We do not treat use of a cloud service as an automatic waiver of this right. To exercise a withdrawal right, email us with your account email and purchase date before the deadline. We issue legally required refunds to the original payment method without undue delay and within the period required by law.

We do not offer a separate voluntary money-back period or prorated refunds after a subscription cancellation. We will correct duplicate charges, billing errors, and charges for service materially not supplied. This policy does not limit any statutory withdrawal, refund or other consumer remedy that applies to a monthly, yearly or Lifetime purchase.

7. Your content and venue information

You retain ownership of the band information, tour plans, notes, and messages you submit. You grant us a limited, worldwide licence to host, process, copy, and transmit that content only as needed to provide, secure, and support the service. You confirm that you have the rights needed to provide it. Public professional venue information may be corrected or removed when a venue or authorised representative gives us reliable evidence.

8. Acceptable use

You may not interfere with the service, bypass access controls, scrape protected contact data, probe security, introduce malicious code, impersonate another person, infringe rights, or use the service unlawfully. You may not resell access or venue data without written permission.

9. Third-party services

BookTheTour relies on third-party services for authentication, hosting, database storage, mapping, email, and payments. Their availability and separate terms may affect parts of the service. Links to venue and other external sites are provided for convenience; we do not control their content or business decisions.

10. Intellectual property

BookTheTour software, design, branding, and original content belong to the operator or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service while your account is active.

11. Availability and liability

We use reasonable care to operate the service, but uninterrupted or error-free availability is not guaranteed. To the maximum extent allowed by law, we are not liable for venue decisions, missed bookings, inaccurate third-party data, travel disruption, or indirect business loss. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory consumer protections.

12. Suspension and termination

We may restrict or suspend access for non-payment, a material breach, misuse, or a credible security or legal risk. Where practical, we will give notice and a chance to remedy the issue. You may stop using the service, cancel a subscription, export your data, or delete your account at any time.

13. Governing law and disputes

These Terms are governed by the laws of Portugal. If you are a consumer, this choice does not remove mandatory protections of the country where you habitually reside or your right to use courts that applicable consumer law makes available. Please contact us first so we can try to resolve a complaint.

14. Changes and contact

We may update these Terms for legal, security, or product changes. We will give reasonable notice of material changes through the service or by email.
